TERMS AND CONDITIONS

1. Membership Typer

Users must register for a BWV account to access the platform. BWV offers two membership tiers (or more): a free (Basic) account and a paid (Premium) account. Free accounts provide access to basic features (such as browsing the Network feed and limited analytics), while paid accounts include additional benefits (for example, advanced data and market analytics, premium content, or priority support). Benefits and features for each tier are detailed on the website and may change over time. All membership fees (for paid accounts) are as posted on the site at time of subscription and are non-refundable unless required by law. BWV may modify membership tiers, benefits or fees at any time, providing notice of significant changes to users.

2. User-Generated Content

BWV allows users to post content to the network feed and to Buy & Sell listings. You retain ownership of your own content, but you grant BWV a license to display and use it on the platform (for example, editing or sharing it) in order to operate and improve the service. All user content must comply with BWV’s content guidelines. In particular, users must not post anything illegal, offensive, infringing, pornographic or otherwise inappropriate. BWV moderators will review every post and listing before it goes live. We reserve the right to refuse, edit or remove any user content that violates these Terms or our policies. Users are solely responsible for their content: you must ensure you have any rights or permissions needed (for example, for copyrighted material or personal images), and you assume all liability for your posts and listings. BWV is not responsible for the conduct of other users or for any interactions that take place between users on the platform.

3. Marketplace Listings

All Buy & Sell marketplace listings must be curated and approved by BWV. Users cannot publish marketplace offers or listings without prior review. To create a listing, a user submits it for BWV’s approval; BWV will check it for compliance with our standards (e.g. legality, accuracy, relevance to agriculture, no scams). If a listing is approved, it will appear on the site; if not, BWV may reject or remove it. Users must provide truthful, complete information in listings. BWV makes no warranties about the quality or outcome of any transaction resulting from a listing. Any deal or agreement is strictly between the buyer and seller; BWV is not involved in the transaction, does not guarantee payment or delivery, and is not liable for any loss or damage arising from user transactions.

4. Data Collection and Analytics

BWV collects data about how users interact with the platform in order to improve the service and provide analytics features. This may include usage data (such as pages or posts you view, searches, login times, and device/IP information), content interaction data (likes, comments, shares, clicks on listings), and any information you submit to the site. We may use cookies or similar technologies to gather this data. We use collected data to generate insights (for example, site-wide usage statistics or personalized recommendations) and to improve BWV’s functionality. Personal data is handled according to BWV’s Privacy Policy and applicable law. As an Alberta-based service, BWV complies with Alberta’s Personal Information Protection Act (PIPA) and Canada’s privacy laws. In particular, we require consent to collect personal information. By using BWV and providing data (for example, registering an account or posting content), you consent to BWV’s collection and use of your data as described. These practices allow us to offer analytics features (e.g. usage reports or market trends) and to enhance and customize the platform. BWV will not sell your personal information to third parties; we may share aggregated or anonymized data (for example, total site traffic or commonly shared content) for research or business improvements. If required by law or requested by you (for example, to update or delete your data), we will comply as described in our Privacy Policy.

5. Third-Party Integrations

BWV may include or link to third-party content and services, such as embedded YouTube videos, advertisements, and affiliate or sponsored materials. These integrations are provided for your convenience and are governed by those third parties’ own terms and policies. For example, embedded videos are subject to YouTube’s terms, and advertisements/affiliate links are served by external networks. BWV does not control third-party sites or content and is not responsible for their accuracy, availability or security. Links to external sites or resources do not imply endorsement; they are provided “as is” and we disclaim liability for anything on those sites. Any interaction you have with third-party content (such as clicking an ad or following an affiliate link) is at your own risk. If we include affiliate or partner content, BWV may receive a commission if you make a purchase through the link; such relationships will be disclosed where required.

6. Jurisdiction

These Terms and your use of BWV are governed by the laws of the Province of Alberta and the federal laws of Canada. Any legal disputes will be resolved under Alberta law. You agree to submit to the exclusive jurisdiction of Alberta courts for any claim arising from these Terms or your use of the platform. (In other words, Alberta law applies, and any lawsuit must be brought in Alberta.)

7. Limitations of Liability

You use BWV at your own risk. BWV provides the website and services “as is” and “as available” without warranty of any kind. We do not guarantee uninterrupted access or error-free operation of BWV, and we are not responsible for any technical failures (such as server downtime or bugs). BWV expressly disclaims all warranties, including any implied warranties of accuracy, completeness, merchantability or fitness for a particular purpose.

BWV is not liable for any direct or indirect damages, losses or expenses arising from your use of the platform. This includes (without limitation) any lost profits, lost data, business interruption, personal injury or other harm. For example, BWV is not responsible if a user’s listing does not sell, or if information on the site is incorrect. We are also not responsible for content posted by other users or third parties (see above). To the fullest extent permitted by law, BWV’s total liability for any claim related to these Terms or BWV services will be limited to the amount you have paid BWV in fees in the 12 months prior to the claim (for free users, this amount is zero). Some jurisdictions do not allow certain limitations of liability; in such cases BWV’s liability is limited to the maximum extent permitted by law.

8. Modifications

BWV may revise or update these Terms at any time. If we make material changes, we will attempt to notify you (for example by email or a prominent notice on the website). Your continued use of BWV after any change means you accept the new Terms. If you do not agree to the updated Terms, you should stop using the service. (As one Alberta government site puts it, “BWV may amend these Terms… at any time without prior notice. Your acceptance of the Terms constitutes your consent to the amended Terms”.) You should review the Terms periodically for updates.

9. Termination

BWV reserves the right to suspend or terminate any user account, at our discretion, for any violation of these Terms or any BWV policies. f you breach the rules (for example, by posting prohibited content or attempting to game the system), BWV may delete your content, suspend your account, or ban you from the platform. We may also terminate accounts for inactivity or other reasons. Upon termination, your right to use BWV ceases, but BWV’s disclaimers and provisions about liability, jurisdiction, etc. will continue to apply.
